These terms are the agreement between you and the independent developer based in Turkey who makes Kishi Notch (“we”, “us”). By installing or using Kishi Notch, you agree to them. Your mandatory consumer rights always apply on top.
Buying Kishi Notch
Kishi Notch is sold through Polar (Polar Software, Inc.), an authorised reseller acting as Merchant of Record. Polar processes your payment, invoice and taxes under its own terms.
A licence costs US$19.99, paid once. Local taxes, where they apply, are added at checkout, which shows the final price before you pay.
Free trial
You can use every feature of Kishi Notch free for 7 days from the day you first open it. No card or account is needed. When the trial ends, the notch island turns off until you enter a licence key.
Your licence
Each purchase gives you a personal, non-exclusive, non-transferable licence to use Kishi Notch on up to 2 of your own Macs at a time, for personal use or for internal use in your business. Kishi Notch is licensed to you, not sold. To move your licence to another Mac, remove it from the old one in Kishi Notch’s Settings.
What you may not do
- resell, rent, lend or sublicense Kishi Notch or your licence;
- redistribute copies of the app or share licence keys;
- get around or disable the licence or trial checks;
- reverse engineer, decompile or disassemble the app, except where the law allows it despite this restriction.
Updates
Your licence includes every update to version 1 of Kishi Notch at no extra cost. A future major version may be sold separately; if it is, the version you already have stays yours. An update may change how a feature works.
How Kishi Notch works with macOS
Kishi Notch reads system information from macOS, such as battery, calendar, Bluetooth, Focus and media playback. Apple can change how macOS provides this information, so a macOS update may stop a feature from working until we release a fix. We can’t promise that every feature will keep working on future versions of macOS.
Provided “as is”
Kishi Notch is provided “as is” and “as available”. To the extent the law allows, we make no other promises about it, for example that it is free of errors or suits a particular purpose. This doesn’t limit your statutory rights as a consumer.
Limitation of liability
To the extent the law permits, we are not liable for indirect or consequential losses, such as lost data or lost profits, and our total liability is limited to the amount you paid for your licence. Nothing here limits liability that the law does not allow to be limited, such as for intent or gross negligence.
Your consumer rights
If you are a consumer, nothing in these terms limits your mandatory rights, including those under Turkish Consumer Protection Law No. 6502 and EU consumer law. Refunds follow Polar’s refund policy, in addition to your statutory rights.
Trademarks
Apple, Mac, MacBook, AirPods and macOS are trademarks of Apple Inc. Other product names on this site and in the app belong to their owners and are used only to describe compatibility. Kishi Notch is an independent product and is not affiliated with or endorsed by Apple or any other brand named.
Governing law
These terms are governed by the laws of the Republic of Turkey. If you are a consumer living in another country, you also keep the protection of that country’s mandatory laws. Consumers in Turkey can apply to consumer arbitration committees and consumer courts.
Changes to these terms
We may update these terms. We will post the new version here with a new date. Changes apply from that date and don’t take away a licence you have already bought.
